Types and scope of services
Through the Service, the Provider offers free and paid services, in particular:
- maintaining a User Account;
- browsing and searching clubs, competitions, seminars, start lists and results;
- registering for Events organized by Clubs;
- Subscriptions (Agility Premium and Trainer Pro);
- facilitating payments for Event participation and organizational fees;
- communication (chat, e-mail and push notifications);
- course design and the LAIKA rules assistant.
The detailed obligations of Organizers (Clubs) are additionally set out in the Club Terms.
Nature of the services - intermediary model
The Service acts as a technical platform connecting Organizers (Clubs) with Participants. The contract concerning participation in a competition, seminar, training or membership is concluded directly between the Organizer and the Participant.
The Provider is not a party to the contracts concluded between the Organizer and the Participant. The Provider's role is limited to making the software tool available and, to the extent chosen by the Organizer, to facilitating payment. The Organizer independently sets the terms of participation, the amount of fees and the rules for their refund, and is responsible for organizing and running the Event.
The exceptions are: (1) the sale of goods in the Agilix shop, where the Provider is a party to the sales contract, and (2) Subscriptions, where the service is provided by the Provider.
Technical requirements
To use the Service you need: internet access, an up-to-date web browser or the Agilix mobile app (iOS or Android) and an active e-mail address. The Provider applies technical and organizational measures appropriate to the risks; however, use of the internet involves typical risks that the User should counter on their own.
User Account
An Account is created by providing an e-mail address and password or by logging in with a Google, Apple or Facebook account. An Account may be created by a person who is at least 16 years old; a younger person may use the Service with the consent and under the supervision of a legal guardian. The User must provide true and current data and protect their login credentials. The Account agreement is concluded for an indefinite period; the User may delete the Account at any time in the app (Profile, then My data, then "delete account") or by contacting the Provider.
Subscriptions and payments
- Agility Premium - paid access to extended web features, charged via the Stripe operator, on a recurring subscription basis.
- Trainer Pro - a subscription in the mobile app, billed via the App Store (Apple) or Google Play in accordance with the rules of those stores; cancellation is done in the settings of the relevant store.
- Event participation fees - collected via the Tpay payment operator; the Provider facilitates forwarding the payment to the Organizer.
- Competition organization fee - a fee owed to the Provider by the Organizer for running a competition in the Service, paid via the Tpay operator.
Prices are given in Polish zloty (and, for subscriptions purchased in the mobile app, in the currency indicated by the App Store or Google Play) and include applicable taxes. Subscriptions renew automatically for the next billing period unless cancelled before it begins.
The invoice for the competition organization fee is issued by the Provider at the Organizer's request, based on the billing details provided during payment. For a Trainer Pro subscription purchased in the mobile app, the sale is settled by Apple (App Store) or Google (Google Play) and the purchase documents are issued by the relevant store - the Provider does not issue invoices for those transactions.
Right of withdrawal (Consumer)
A Consumer who has concluded a distance contract with the Provider (for example a Subscription) may withdraw from it within 14 days without giving a reason by sending a statement to [email protected]; the model form available on the Withdrawal page may be used. For a Trainer Pro subscription purchased in the mobile app, the refund is made through the App Store or Google Play in accordance with the procedures of those stores.
The right of withdrawal does not apply if the Provider has fully performed a digital service with the Consumer's express prior consent, the Consumer having been informed that they would lose the right of withdrawal once performance is complete and having acknowledged this. Such consent may be given when concluding the contract, for example by ticking the relevant box. If the Consumer requested that performance begin before the withdrawal period expires and then withdraws, the Consumer pays for the services performed up to the moment of withdrawal, in proportion to the scope of the service performed.
The rules for cancelling participation in an Event and refunding the fee are set by the Organizer. For contracts for services related to sporting or entertainment events, the right of withdrawal is excluded by law where the contract specifies the day or period of the service (Article 38(1)(12) of the Polish Consumer Rights Act).
User content
A User who posts content in the Service (in particular competition photos, club descriptions and logos, avatars) declares that they are entitled to use it and grants the Provider a free, non-exclusive licence to display it in the Service and to use it in promotional activities related to the Service. Posting content that is unlawful or infringes the rights of third parties or good morals is prohibited.
Prohibited conduct
The following is prohibited in particular:
- providing false data or impersonating others;
- posting content that is unlawful, vulgar or unrelated to the topic of dogs;
- infringing the rights of other Users;
- attempting to disrupt the Service or gain unauthorized access;
- using the Service for aggressive marketing or redirecting traffic to other platforms;
- acting to the detriment of the Provider.
Breach of the above rules may result in blocking the Account or the club.
Content that infringes the law or these Terms can be reported to [email protected]. Reports are reviewed by the Provider. The Provider informs the affected User by e-mail, with reasons, about the removal of content or the blocking of an Account or club; the decision can be contested through a complaint.
Liability
The Provider is not liable for: contracts concluded between the Organizer and the Participant, the organization, course and quality of Events, or the content posted by Users. Complaints about an Event should be addressed to the Organizer.
The Provider makes efforts to keep the Service continuously available but does not guarantee uninterrupted operation and reserves the right to technical breaks. The above limitations do not exclude or limit the Provider's liability towards a Consumer to the extent prohibited by mandatory law.
Complaints
Complaints about services provided by the Provider may be submitted to [email protected]. A complaint should contain data allowing identification of the User, a description of the circumstances and the request. The Provider considers a complaint within 14 days of receipt. Complaints about the course of Events are considered by the Organizer. The Provider bears statutory liability towards Consumers for the conformity of the Subscription (a digital service) with the contract, under chapter 5b of the Polish Consumer Rights Act.

Changes to the Terms
The Provider may change the Terms for valid reasons (legal or technical changes or changes to the scope of services). Registered Users will be informed of a change at least 15 days in advance at the e-mail address linked to the Account or within the Service. Non-acceptance of the changes entitles the User to terminate the Account agreement. Services already commenced are governed by the Terms in their previous wording.
Final provisions
Matters not covered are governed by Polish law, provided that this choice does not deprive a Consumer of the protection afforded by the mandatory provisions of the law of their country of habitual residence. The Terms apply from the date of publication.
