Club management terms
Rules and regulations for running a club in the Agilix app. Learn about cooperation terms, administrator obligations and platform usage rules.

These Club Terms supplement the general Terms of Service and set out the additional obligations of Organizers (Clubs). The terms "Provider" and "Service" have the meaning given to them in the Terms of Service.
1. General Provisions
- a. Agilix allows clubs to be run according to their own rules, provided that specified guidelines are followed.
- b. Using the platform means accepting these terms and committing to comply with them.
2. Positive dog training methods
- a. Agilix supports and promotes positive dog training methods, emphasizing a responsible and ethical approach to working with animals.
- b. The Agilix platform is not responsible for actions of clubs that do not adhere to positive training principles.
- c. If a club uses methods that may be considered animal abuse, Agilix reserves the right to immediately block such a club in order to protect animal welfare and platform integrity.
3. Club's care for user convenience
- a. Agilix was created with easy access to information and services related to broadly understood dog training in mind, caring for user convenience and positive experiences.
- b. To ensure the above point, Agilix recommends that the club add: club description, activity-related tags, club regulations, address with map pin, and photos.
4. Subscription
- a. Running classes on the platform requires purchasing a subscription, which enables use of full Agilix features.
- b. Each trainer is required to pay for their own subscription to provide services through the Agilix platform.
- c. Using a single club subscription to create or manage trainings on behalf of trainers who do not have their own active subscription is prohibited.
5. Responsibility for trainers' actions
- a. Clubs bear full responsibility for the actions of their trainers and compliance of their practices with Agilix terms.
6. Prohibited content and activities
- a. Publishing vulgar, controversial, pornographic content and conducting activities unrelated to dog topics is prohibited.
- b. Clubs that do not meet these conditions may be blocked by Agilix.
7. Using the platform for advertising purposes
- a. Agilix allows club owners to place external links, provided they serve to support the substantive purpose of the club.
- b. However, creating clubs that exist solely to redirect users to other platforms is prohibited. If such activities are detected, Agilix may decide to block the club.
8. Actions in case of terms violations
- a. In the event of a violation of these terms, the Agilix team will make every effort to cooperate with club owners, helping to identify problems and remove inappropriate content.
- b. However, if violations recur or are not remedied in a timely manner, Agilix reserves the right to block the club. In cases of gross violation of the rules, the account of the user responsible for running the club may also be blocked.
- c. Every Agilix user has the right to report terms violations, including inappropriate content, trainer behavior, or club practices.
- d. Agilix informs the Organizer about the blocking of a club or termination of the agreement by e-mail, together with a statement of reasons. Permanent termination of the services provided to the Organizer takes effect upon 30 days notice, unless an exception under Article 4(4) of Regulation (EU) 2019/1150 applies, in particular repeated infringements of the Terms.
9. Platform integrity protection
- a. Agilix takes actions to ensure the safety and comfort of using the platform by all users, regardless of their age.
- b. Any action that violates the integrity of the application, including systematic violation of the terms or activities inconsistent with the purpose of the platform, may lead to the blocking of the club and, in cases of serious abuse, the user account.
10. Intellectual property rights
- a. Club owners retain rights to the content they publish on the platform, but grant Agilix a non-exclusive license to use it for purposes related to the operation of the platform.
- b. Any actions infringing copyright or other intellectual property rights may result in content removal or club blocking.
11. Personal data management
- a. Agilix ensures the protection of users' personal data in accordance with applicable law, including GDPR.
- b. Club owners are responsible for processing the personal data of club members within their activities.
12. Terms changes
- a. Agilix reserves the right to make changes to the terms.
- b. Continuing to use the platform after changes are made constitutes acceptance of the updated terms.
13. Intermediary model and event fees
- a. The Club is the Organizer of events. The contract for participation in an event is concluded directly between the Club and the Participant; Agilix is not a party to that contract and acts solely as a technical platform.
- b. The Club independently sets the terms of participation, the amount of fees and the rules for their refund. Participation fees are collected via the Tpay payment operator and forwarded to the Club.
- c. The Club is responsible for tax settlements and issuing sales documents to Participants in accordance with applicable law.
14. Protection of Participants' personal data
- a. In respect of Participants' personal data processed in connection with organizing events, the Club is a separate data controller and bears the related obligations, including the information obligation and handling the rights of data subjects.
- b. The Club undertakes to process Participants' data in accordance with the GDPR and solely for purposes related to organizing events.
15. Service availability and Agilix liability
- a. The Service operates on infrastructure provided by external suppliers, in particular Hetzner Online GmbH, Google (Firebase, Google Cloud), Amazon Web Services, Cloudflare and payment operators. The Provider has no influence over the operational continuity of those suppliers. The Provider does not guarantee uninterrupted availability of the Service and reserves the possibility of technical breaks, failures and fortuitous events.
- b. The Organizer acknowledges that use of the Service requires internet access and that its operation depends on third-party infrastructure. Before the event begins, the Organizer undertakes to download and retain start lists and the data necessary to run the competition in a form usable without access to the Service, and to provide a fallback method of running the competition.
- c. The Provider is not liable for non-performance or improper performance of the Service resulting from failures, outages or acts of suppliers of infrastructure, hosting, internet links, power supply and payment services, nor from attacks on infrastructure or force majeure. To that extent the Parties exclude the application of art. 474 of the Polish Civil Code.
- d. The Provider is not liable for indirect damage, including lost profit, lost revenue, the costs of organizing the event, refunds paid to Participants, third-party claims brought against the Organizer, and reputational harm.
- e. The Provider's total liability to the Organizer for non-performance or improper performance of the Service is limited to the amount of fees paid by the Organizer to the Provider for the event to which the damage relates.
- f. The above limitations do not apply to damage caused intentionally and do not exclude liability to the extent prohibited by mandatory law.
These terms apply to all club owners on the Agilix platform.
