Agilix Photo Terms

Version effective from 28 August 2026.

These Terms set out the rules for using Agilix Photo, the service where photographers share and sell photos from dog sport competitions. They supplement the Terms of Service, which apply to every Agilix application.

The operator of the service, meaning the entity that runs the platform and handles payments, is:

The operator is not the seller of the photos. The seller is the photographer who listed them in their gallery. The photographer is named on the gallery page, and the payment goes straight to their payout account.

Who is who

The photographer is the user who creates a gallery, uploads photos and offers them for sale. The buyer is the user who buys them. The operator provides the tools, stores the files and intermediates the payment, taking a commission on the sale. The contract of sale is concluded between the buyer and the photographer.

The photographer's obligations

By uploading a photo, the photographer declares that they hold the copyright to it and may distribute and sell it. They are also responsible for the consent of the people shown in the photos, where such consent is required. The copyright stays with the photographer. The photographer grants the operator a free licence to store the photos, to show their previews in the service and in notifications, and to sell them on the photographer's behalf, solely to the extent needed for Agilix Photo to work.

What we store

The service stores compressed previews only. The photographer uploads the original files after a sale, and the operator keeps them for 60 days from the upload and then deletes them. The buyer should download the purchased file within that time. Once the original is deleted, the photo remains with the photographer, who can be asked to share it again.

The delivery deadline

The photographer uploads the original file within 7 days of the purchase. If they do not, the operator refunds the buyer for the photos that were not delivered. The refund covers the undelivered photos only and happens automatically, without a request from the buyer. Photos delivered on time remain paid for.

Buying a photo

Prices are shown in the currency of the photographer's payout account and include all charges. The payment is handled by a payment operator and the funds go to the photographer's account, from which the operator takes its commission. Buying requires signing in and accepting these Terms. Once the order is paid, the buyer gets access to the original file as soon as the photographer uploads it.

What you may do with a photo you bought

The buyer receives a licence for personal use: they may view the photo, print it, publish it on social media and share it with family. The licence does not cover reselling the photo, sub-licensing it or any commercial use, including advertising. Such use needs the photographer's separate consent. The copyright stays with the photographer, and it is good practice to credit them when publishing.

The right of withdrawal

A photo is digital content delivered as a file. Under art. 38(1)(13) of the Polish Consumer Rights Act, the 14-day right of withdrawal does not apply where the seller began performance with the buyer's prior express consent, the buyer having acknowledged that they lose the right once performance is complete. The buyer gives that consent by ticking the box before the purchase; without it the purchase does not proceed. Until the original file is delivered, the buyer may withdraw from the contract by writing through the Contact page. The consent does not limit the rights arising from digital content not conforming to the contract.

Content taken down by the operator

The operator may take down a photo or a whole gallery if it has reasonable doubts about the rights to the photo, the consent of the people shown in it, or whether the content is lawful. The content stops being visible and cannot be bought, and the photographer sees the reason in their gallery. The decision is reversible. Complaints

A complaint about a photo, its quality or the delivery deadline is handled by the photographer as the seller. A complaint about how the service, a payment or a refund works is handled by the operator. A report can be sent through the Contact page, and the operator passes it on to the photographer where the matter concerns the sale. A reply is given within 14 days.

How the service runs

The operator makes efforts to keep the service continuously available, but does not guarantee uninterrupted operation. The service runs on third-party infrastructure. Liability is governed by the Terms of Service.

Personal data

How personal data is processed is described in the Privacy Policy. Competition photos may show people; if someone asks for their image to be removed, please write through the Contact page.

Changes to these terms

The operator may change these Terms for important reasons, including a change in the law or in the scope of the service. Registered users are notified by e-mail at least 15 days before a change takes effect. Orders placed earlier are governed by the version in force at the time of the purchase.

Final provisions

Matters not covered by these Terms are governed by the Terms of Service and by Polish law. The Polish version is the binding one.
